Description

Camera on the back of Harry Bourke, a man in his late 70s, and David Bourke, in his mid-40s, approaching the Guardianship Tribunal receptionist.
David: Harry Bourke and David Bourke. (Camera on David and Harry. Middle aged woman walks in and touches Harry on the arm. Harry turns away.)
Margaret: Hello Dad. (Margaret walks around to stand next to David.)
David: What time is the hearing.
Margaret: Hi David. (David turns his head towards Margaret.)
David: G'day.
Close up of receptionist.
Receptionist: Good morning. You're also here for Mr Bourke's hearing?
Close up of Margaret.
Margaret: Yes. I'm Margaret Foster.
Close up of receptionist.
Receptionist: Here's a copy of the report for you to read. (She hands copies of report to Margaret, David and Harry.)
Please take a seat and the Tribunal will call you shortly.
Camera on David, Margaret and Harry.
David: Thanks
Margaret: Thanks very much.
Camera on Margaret David and Harry as all three turn to sit in reception area David guides his father by the elbow.

Marion: My name is Marion Brown. I'm presiding at today's hearing. (Camera is on all three members) With me is Jennifer Newman, our community member.

Camera on David, Harry and Margaret. David and Margaret look at Harry.
Harry: I always have.

Getting evidence from parties
Description
The Tribunal asks the different parties to the hearing their opinion about the person's ability to look after themselves.

Camera moves from Angela, the social worker, to Harry (over Marion's shoulder).
Marion: Mr Bourke, the social worker and your children are concerned (close up on Marion) that you might not be able to look after yourself as well as you used to.
Close up on Harry who looks around the table.
Harry: You're all just wasting your time. I'm not moving anywhere.
Close up on Marion.
Marion: Is that what you want, Mr Bourke? (Close up on Harry) To stay in your own home?
Camera shifts to David close up, then on Marion.
Marion: So what did you do?
Close up on David.
David: Well I called the Aged Care Assessment Team and arranged with Angela to visit Dad.
Focus on Jennifer, community Tribunal member, then on Angela.
Jennifer: So Angela, you assessed Mr Bourke as being eligible for a community aged care package?
Close up on Angela.
Angela: Yes, a regular carer to help with meals, laundry and personal care will greatly assist (Camera on David, Harry and Margaret) Mr Bourke to stay in his own home.
Close up on Jennifer who nods agreement.
Angela: Down the track, (close up on Angela) he may need 24-hour care.

Marion: The existing arrangement with David having power of attorney seems to be working well. (Camera on Angela, David, Harry and Margaret on other side of table, seen over Tim's shoulder) And there's no reason why that shouldn't continue.
Camera on David with chin on hand and Harry.
There's no evidence of any need to appoint a financial manager (camera on Harry and Margaret) and we've decided to dismiss that application.
Close up on Marion.
From the reports provided and what we've seen and heard today, we're satisfied that Mr Bourke is not able (close up on Harry) to make his own personal decisions and he needs a guardian to make substitute decisions in his own best interests.

We've decided to appoint his son, David, (close up on Harry) to be his guardian (close up on David) for a period of 12 months to make decisions about what services (close up on Margaret who looks down) Mr Bourke receives.
