The 'Application for Recognition of Interstate Appointment' form should be completed if you have been appointed as a person’s guardian or financial manager (or administrator) outside of NSW and you wish to have that appointment recognised by the Guardianship Tribunal of NSW.
The Guardianship Tribunal can only recognise appointments that have been made under corresponding law in other Australian states - Victoria, Tasmania, South Australia, Western Australia, Queensland, the Northern Territory, the Australian Capital Territory - or in New Zealand.
Applications for recognition can only be made by the person who was appointed as guardian and/or manager/administrator.
If the appointment is recognised, you will be sent a formal determination of the Tribunal. This will be your authority to act in NSW within the terms of the original order. This recognition only has effect for the period of time specified in the original order.
Recognition of an interstate appointment can only authorise you to perform functions authorised in the original appointment which are also functions authorised under the Guardianship Act 1987 of NSW.
Having the appointment recognised in NSW does not automatically affect the operation of the order in the state, territory or country in which it was made. The original order will still be reviewed and will still operate within that jurisdiction. Recognition of your appointment will allow you to operate on the original order in NSW.
If your appointment as a financial manager is recognised in NSW, you will be subject to the supervision and direction of the Protective Commissioner of NSW. After your appointment is recognised you will need to contact the Office of the Protective Commissioner to develop and have approved a set of directions which will give you your specific authorities to act in NSW. The Protective Commissioner will need you to provide information about the person’s estate that you are responsible for as the appointed manager. There may be some fees charged by the Office of the Protective Commissioner for this service.
All appointments recognised by the Guardianship Tribunal of NSW will be reviewed by this Tribunal within 12 months. You will be advised of the review date in writing.
You can print out the 'Application for Recognition of Interstate Appointment' form, complete it and return it to the Guardianship Tribunal along with a copy of the original order, appointing you as guardian and/or manager.
