NSW Trustee and Guardian Act 2009

The NSW Trustee and Guardian Act 2009 came into effect on 1 July 2009. Under this legislation, a new organisation is created, the NSW Trustee and Guardian. The NSW Trustee and Guardian will perform the roles previously exercised separately by the Protective Commissioner and the NSW Public Trustee. The Protected Estates Act 1983 is also repealed and replaced with the NSW Trustee and Guardian Act 2009.

References to the Protective Commissioner or the Office of the Protective Commissioner in the Tribunal's website and publications will be amended in due course. In the interim all references to the Office of the Protective Commissioner or the Protective Commissioner should be taken to refer to the NSW Trustee.
